By accessing our website at dammy5ive.com or submitting a booking request, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our website or services.

These Terms constitute the full agreement between you and Dammy5ive Photography regarding the use of our services. We reserve the right to update these Terms at any time; continued use of our services after changes constitutes acceptance.

Submitting a booking request through our website does not guarantee a confirmed session. All bookings are subject to availability and our review. A booking is only confirmed once you receive a written confirmation email from us.

We reserve the right to decline any booking request at our discretion without being required to provide a reason.

You are responsible for providing accurate contact information and session details. We are not liable for missed communications resulting from incorrect information.

Session fees are discussed and agreed upon prior to or at the time of booking confirmation. All fees are quoted in Canadian Dollars (CAD) unless otherwise stated.

A deposit may be required to secure your booking date. The remaining balance is due on or before the session date unless otherwise agreed in writing. Invoices are issued upon completion of the session and payment is due within the timeframe stated on the invoice.

Late payments may incur interest at a rate of 1.5% per month. We reserve the right to withhold delivery of final images until full payment is received.

Client cancellations: Cancellations made more than 72 hours before the scheduled session will receive a full refund of any deposit. Cancellations within 72 hours of the session may result in forfeiture of the deposit.

Rescheduling: You may reschedule your session once at no charge with at least 48 hours' notice, subject to our availability. Additional rescheduling requests may incur an administrative fee.

Photographer cancellations: In the unlikely event we must cancel, you will receive a full refund of any deposit paid and we will make reasonable efforts to assist you in rescheduling.

All photographs produced by Dammy5ive Photography remain the intellectual property of Dammy5ive Photography and are protected under Canadian copyright law. You are granted a personal, non-exclusive, non-transferable licence to use the delivered images for personal purposes.

Commercial use of images (advertising, promotional materials, resale, etc.) requires a separate written commercial licence agreement.

We reserve the right to use any photographs taken during your session in our portfolio, website, social media, and marketing materials unless you notify us in writing prior to the session that you wish to opt out.

By booking a session and unless you provide written notice to the contrary before the session date, you grant Dammy5ive Photography a non-exclusive, royalty-free licence to use images from your session for portfolio and promotional purposes.

We will never sell your images to third parties or use them in a manner that could be considered defamatory or harmful to your reputation.

Final edited images will be delivered within the timeframe communicated at or after your session (typically 5–14 business days depending on session type). Rush delivery may be available for an additional fee.

Images are delivered digitally via a secure online gallery or download link. It is your responsibility to download and back up your images within the access window provided. We are not responsible for images that are lost after the delivery link expires.

The number of edited images delivered will be at our professional discretion. We do not guarantee delivery of all photographs taken during a session.

You agree to conduct yourself and any accompanying persons in a respectful and professional manner during the session. We reserve the right to end a session immediately and without refund if any person engages in abusive, threatening, or inappropriate behaviour toward our staff.

You are responsible for ensuring that any minors in the session are accompanied by a parent or legal guardian and that appropriate consents are in place.

In the event of equipment failure, unforeseen circumstances, or force majeure (including extreme weather, acts of God, or other events beyond our reasonable control), our liability is limited to a full refund of fees paid.

We are not liable for indirect, incidental, or consequential damages arising from the use or inability to use our services, including but not limited to loss of business opportunities or emotional distress.

Our total liability in any circumstance shall not exceed the total fees paid by you for the relevant session.

Our website is provided "as is" without warranties of any kind. We do not guarantee that the website will be uninterrupted, error-free, or free of viruses. You access our website at your own risk.

You agree not to use our website for any unlawful purpose, to attempt to gain unauthorised access to any part of our systems, or to transmit any harmful, offensive, or infringing content.

These Terms and Conditions are governed by the laws of the Province of Saskatchewan and the federal laws of Canada applicable therein. Any disputes shall be subject to the exclusive jurisdiction of the courts of Saskatchewan.
